Tickets Sales and Participation

Stuff Limited (“Stuff”) organises and hosts the NZ House & Garden House Tours (“the Tours”). By registering to participate in the Tours you (“the Participant”) acknowledge and agree that these terms and conditions (“Terms”) apply to your registration and participation in the Tours and acknowledge that these terms and conditions may be subject to change from time to time at the discretion of Stuff without notice to the Participant.

Agreement Waiver and Indemnity
I declare that I am not aware of any illness, injury, physical disability or impairment which may cause me injury or death during or as a consequence of my attending the Tours.
The decision to attend the Tours is entirely my own and I accept all risks associated with my attending the Tours, including but not limited to, loss of life or permanent injury. I agree to accept full responsibility to inform myself and assess all the dangers, hazards and risks of attending the Tours, and rely solely on my own assessment of these dangers, hazards and risks before participating in the Tours and notwithstanding any decision made by the Tour organisers and other persons, corporations and bodies involved, engaged in promoting or staging the Tours.
To the fullest extent permitted by law, I release all persons or corporations associated directly or indirectly with the Tours from all claims, demands and proceedings arising out of my attending and I hereby indemnify such persons or corporations against all liability, loss or damage arising out of my attending the Tours, including any breach of these terms and conditions by me. This liability, loss or damage includes, but is not limited to, the cost to defend or settle any claim, suit, action or proceeding brought against Stuff. This release extends to and includes Stuff and its related companies, their respective directors, officers, agents, contractors, employees, promoters, sponsors and volunteers, including medical and paramedical personnel appointed for the Tours, the owners, licensees and occupiers of land upon which the Tours or any part of it takes place, any statutory body or local authority having control over any land upon which the Tours or any part of it takes place or which is involved directly or indirectly with the Tours in any manner whatsoever. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.
All conditions and warranties which may be implied by law into these terms and conditions are excluded except to the extent that it would be unlawful to do so.
Tour Rules and Regulations
Tickets for the Tours are subject to availability and are available on a first come first served basis. Tickets can be purchased from www.nzhouseandgardentours.co.nz
I understand that Stuff reserves the right to change or modify any part of the Tours, including the date or location at any time and from time to time. Details of any such changes will be published via the Tours website, Tours e-newsletter and/or other means. Stuff will not be responsible for any costs incurred as a result of the Tours being modified in accordance with clause 7.
I acknowledge that Stuff or its representatives may remove me from the Tours and/or exclude me from entering any of the houses (a) if my behaviour is inappropriate, offensive, or abusive, (b) to prevent damage to any property, (c) on medical or health and safety grounds (including to prevent possible harm or injury to myself or any other person), or (d) to prevent or arrest any form of unauthorised marketing, including ambush marketing.
As you will be visiting people’s homes as part of the Tours you will need to be respectful and adhere to all instructions from event staff and volunteers. Stuff reserves the right to remove any Participants who do not adhere to instructions from volunteers or Stuff staff members. It may be a condition of entry to some of the homes that make up the Tour that a search of a person and / or their possessions will be required at the time of the entry and / or exit.
Children under the age of 16 years of age are not permitted to attend the Tours.
Entries may not, without the prior written consent of Stuff, be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If an entry is sold or used in breach of this condition, the entry may be canceled without a refund and the bearer of the entry may be refused admission.
I agree to abide by all Tour rules, terms and conditions. I understand that I must observe normal traffic rules and obey all directions and instructions given by Tour officials and volunteers. The Tour organisers reserve the right in their discretion to reject or cancel my attendance at any time, including without limitation for safety or insurance reasons. Stuff will not be obliged to refund any portion of the ticket price in such circumstances.
I understand that no wheelchairs, walking frames, prams or other equipment, structure or accessories that may cause injury will be permitted inside the houses.
I understand that no shoes must be worn inside the houses, except where Stuff has received written notice of a medical exemption prior to 5:00pm (NZT) on the Wednesday before each tour (Queenstown- Wednesday 14th February, Christchurch - Wednesday 21st February, Whanganui - 13th March, Tauranga - Wednesday 20th March). In the case of a medical exemption, I understand that shoes covers must be worn over my shoes and that these will not be provided to me by the Tour organisers.
I understand that due to the personal nature of private homes of the Tours, no dogs are permitted at the Tours, including guide dogs for the vision impaired, service dogs for medical or disability requirements and working dogs involved in official demonstrations.
I understand that the flying of drones and unmanned aerial vehicles (UAVs) by Attendees without the written authorisation of Stuff is prohibited. Such consent may or may not be granted at Stuff’s sole discretion.

Consent to Medical Assistance
I consent to receive such medical aid or preventative treatment which may be deemed advisable in the unfettered direction of Tour Medical Officials in the event of any injury, accident or illness to me during my attendance of Tours.
I consent to the release of my personal information to medical assistance personnel and Tour organisers in the event of a medical emergency during my attendance of the Tours.
Tour Entry, Refunds and Promotional Codes
I understand that should my contact details change after my ticket purchase is completed it is my responsibility to notify the Tour organisers at housetours@nzhouseandgarden.co.nz
I understand that entry may be refused if tickets are damaged or defaced in any way, or are not purchased via the Tours website.
I understand that it may be a condition of entry that a search of a person and/or their possessions is required at the time of entry into the houses.
Except as set out in clause 23 and 24 below, any refund of the ticket price is at the sole discretion of Stuff. No refund or exchange on tickets will be given, except as required by law. Credit card fees and service fees are non-refundable.
Should the scheduled Tour dates be impacted by government imposed restrictions, Stuff will endeavour to reschedule the Tours to new dates. All Participants will automatically be transferred to new Tour dates, with the option to opt-out. You will have 10 days from the date Stuff sends a postponement notice to you, to communicate in writing to Stuff that you wish to opt out.
1. If the Participant is unable to attend the Tours on the rescheduled date and opts-out before 30 days from the rescheduled tour date, the Participant will receive a full refund, less administrative costs.
2. If the Participant is unable to attend the Tours on the rescheduled date and opts-out within 30 days from the rescheduled tour, the Participant will receive a refund up to but not exceeding 70% of the tickets, excluding transaction fees. The remaining non-refunded amount will be retained to cover reasonable administration & cancellation costs, including the charity donation.
Should any of the Tours be cancelled due to government imposed restrictions, Participants affected by the cancelled Tours will receive a refund up to but not exceeding 50% of the ticket price, excluding transaction fees. The remaining non-refunded amount will be retained to cover reasonable administration & cancellation costs, including the charity donation. No other refund will be given except in line with our refund terms as stipulated in clause 22.
I understand that promotional codes may only be used where an Attendee meets the requirements/conditions applying to the code, including using the relevant code within the period of validity. Promotional codes cannot be redeemed or exchanged for cash and must only be used by the Attendee(s) to whom the relevant code was issued to by Stuff, the event organiser.
I understand that Stuff reserves the right to modify, suspend and/or cancel any promotional code(s) at any time without notice to Attendees and that no refunds will be made to Attendees who have access to a promotional code but did not use the code at the time of purchase.
Contact Tracing & Restrictions
The Participant agrees that their information will be held for the purposes of contact tracing and may be disclosed to the Ministry of Health should the need arise. To the extent that personal information is collected about the Participant, the Participant has read and understands Stuff’s Privacy Policy here: https://www.stuff.co.nz/about-stuff/100909861/privacy-policy. The Participant will comply with any reasonable request from the Organiser to undertake contact tracing, and will at all times comply with the law and/or any NZ or local government or council directives in this respect.
I understand that should the New Zealand Government impose restrictions on event attendance all Participants will be required to comply with any such mandate or requirement. The Organiser reserves the right to remove and/or exclude any Participant who does not meet any imposed condition(s).

Consent to Media Coverage of Event
I consent to the collection, publication and/or use in any form of media whatsoever of my name, image, video, voice, statement or otherwise, (including the publication of my name in any Stuff publication both online and in print and/or on the Tours website) for promotional, marketing or other purposes, without payment or compensation.

Personal Information
I declare that all the information supplied by me is true and correct.
I consent to Stuff entering my personal details contained through the purchase of my tickets into the Tours database, which will be used for the administration of the Tours. Stuff collects personal information to manage participation in the Tours. Unless indicated otherwise, Stuff may disclose the information provided by you to Stuff to its related bodies corporate, and may use the information for marketing future events, and other marketing and promotional purposes, including offering products and services of potential interest to you.

I understand that I can gain access to my personal information and request that such details be updated if they change in the future by writing to the Privacy Officer c|- Legal, Stuff Limited, PO Box 2595 Wellington.

Age Declaration
I certify that I am 16 years or older, or that I am the parent/legal guardian of the participant who is under the age of 18 years, and I have read this document and fully understand it. As a parent or legal guardian, I agree to these terms and conditions for and on behalf of the participant.

Cancellation and Rescheduling of Event
I understand that Stuff reserves the unfettered right to cancel the Tours at any time. Reasons for cancellation may include, but are not limited to, Stuff deciding in its sole discretion cancellation is required due to any sort of dangerous conditions and/or force majeure event. In the event of cancellation but except as set out in clause 22, there will be no refund of the ticket price and the cancelled Tour(s) may not necessarily be rescheduled. A decision will be made as soon as possible about a rescheduled date and communicated to Participants.
Stuff will not be responsible for any costs incurred as a result of the Tour(s) being cancelled or rescheduled in accordance with clause 23 and 24.
